What is the grandfather clause?

The Grandfather Clause is a provision exempting persons or other entities already engaged in an activity from rules or legislation affecting that activity. This term comes up in herpetoculture when a local herp-banning bylaw is passed after acquisition of the newly banned herps, thus this clause can be cited to protect the collector if he/she can prove his/her animals were acquired before the bylaw was passed.

Not everywhere allows herps to be grandfathered.

Nonetheless, it's a huge relief to know that we MIGHT have a way out of having to give up our herps if our locales ban them.

Though it may be a saving grace for many of us keepers, it's no pleasant prospect for us breeders. Although it means you can keep your collection, it also means you cannot breed them, or sell them.

Here in Kelowna they have created a ban on several large pythons and "common" boas. We argued and fought to have it specific to BCC and BCI but in the end they just went with common boa. Basically, if they ever ask, there are so many ways around the boa clause.
